Welcome to Click Me Happy! These Terms and Conditions govern your booking of and participation in our photography services, including but not limited to maternity, newborn, couple, family, wedding, modeling, pet, and advertisement photography. By booking a session with us, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not book our services.

• Booking Fee (Advance): To secure your session date and time, a non-refundable booking fee (refundable upon cancellation from our side) is required at the time of booking. This fee is applied toward your total session cost. Your booking is not confirmed until this fee has been received.

• Final Payment: The remaining balance is due on or before the day of the scheduled photography session. For weddings and large events, the final payment is due at the end of the coverage of the event.

• Payment Methods: We accept various forms of payment including credit/debit cards, digital wallets (UPI), and bank transfers.

• Delivery: Processed images, prints, or other products will not be delivered until the full payment has been received.

• Cancellation by Client: If you cancel your session, the non-refundable booking fee will be forfeited. This fee compensates us for the loss of that booking slot.

• Rescheduling by Client: We understand that unforeseen circumstances can arise. Clients may request to reschedule their session once, provided at least 48 hours' notice is given. The new session date is subject to our availability. Rescheduling with less than 48 hours' notice may incur a rescheduling fee.

• Cancellation by Click Me Happy: In the unlikely event that we have to cancel due to unforeseen circumstances (e.g., illness, emergency), we will make every effort to find a suitable replacement photographer or reschedule the session. If this is not possible, we will issue a full refund of all monies paid, including the booking fee.

• Refunds: Due to the custom nature of photography, no refunds are issued for services already rendered or products delivered.

By booking our services, you agree to:

• Provide accurate information regarding your contact details, event, and location.

• Arrive on time for your session. Late arrival may result in a shorter session time.

• Cooperate with the photographer during the session to ensure the best possible results.

• Ensure the safety of any children, pets, or other participants you bring to the session.

• Secure any necessary permissions or pay any fees required for shooting at a specific location of your choice (e.g., parks, private venues).

• Copyright Ownership: Click Me Happy retains the full copyright to all images and videos created during the session.

• Personal Use License: You (the client) are granted a license to use the delivered images for personal, non-commercial purposes, including printing, sharing on social media, and creating personal products.

• Prohibited Uses: You may not sell, alter (e.g., using photoshop or AI), or use the images for any commercial purpose without explicit written permission from Click Me Happy.

• Portfolio Use: We reserve the right to use images from your session for our portfolio, website, social media, and other promotional materials, as governed by our Privacy Policy and any agreement signed by you. If you wish for your images to remain private, please notify us before your session.

• Artistic Style: Clients acknowledge that they are familiar with our artistic style as shown in our portfolio and that our work is subjective. We are not liable for claims of dissatisfaction with our professional artistic judgment or style.

• Image Loss: In the unlikely event of total photographic failure or loss of images due to equipment malfunction or data corruption before delivery, our liability shall be limited exclusively to a full refund of all payments received for the service.

• Cooperation: We are not liable for a reduced number of images or compromised quality due to the non-cooperation of the subject(s), including children, pets, or other event guests.

You agree to indemnify and hold harmless Click Me Happy, its employees and affiliates from any claims, damages, losses, liabilities, and expenses arising out of or related to your session or your breach of these Terms and Conditions.

Click Me Happy reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after any changes constitutes your acceptance of the new terms.

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts in Kochi, Kerala.
